Pennsylvania Life Insurance Statistics

Pennsylvania ranks among the top five states nationally for annual life insurance death benefit payments. With an industry-wide 10 to 20 percent denial and delay rate, thousands of Pennsylvania beneficiaries face wrongful denials every year. As a Pennsylvania-based firm, we are positioned to handle those cases directly.

Pennsylvania Lapse Law

Pennsylvania requires insurers to provide a 30-day grace period before a life insurance policy lapses for non-payment of premiums. Insurers must send proper notice before declaring a policy lapsed. If the insurer failed to follow required notice procedures, or if the insured died during the grace period, the denial may be wrongful.

Pennsylvania Misrepresentation Standard

Under Pennsylvania law, an insurer may void a life insurance policy based on misrepresentation only if the misrepresentation was material to the risk — meaning it would have changed the insurer's decision to issue the policy or the premium charged. Pennsylvania courts have recognized that not every inaccuracy on an application justifies rescission. The misrepresentation must have been significant and the insurer must have relied on it.

Pennsylvania Divorce and Life Insurance — Automatic Revocation

Pennsylvania is among the states with an automatic revocation upon divorce statute. Under Pennsylvania law, divorce revokes a beneficiary designation in favor of a former spouse, treating the ex-spouse as having predeceased the insured. However, this statute does not apply to ERISA-governed employer policies, FEGLI, SGLI, or VGLI — all of which are governed by federal law.

Our firm has extensive experience in ERISA cases inPennsylvania, where the automatic revocation statute does not apply and ex-spouses may retain their beneficiary rights despite a divorce.

Pennsylvania Accidental Death Exclusions

Pennsylvania courts construe insurance policy exclusions narrowly and in favor of coverage when policy language is ambiguous. An insurer applying an accidental death exclusion must demonstrate clearly that the exclusion applies to the specific facts of the death. Our firm has recovered accidental death benefits in Pennsylvania cases where insurers improperly applied drug, sickness, and intoxication exclusions.
