California Life Insurance Statistics

California consistently ranks as the largest life insurance market in the United States. California Lapse Notice Law — One of the Strongest in the Country

California Insurance Code sections 10113.71 and 10113.72 impose strict requirements on insurers before they can declare a policy lapsed for non-payment of premiums. These laws — among the strongest in the nation — require insurers to:

- Send notice of pending lapse at least 30 days before the lapse effective date

- Send notice within 30 days after a premium is due and unpaid

- Mail all notices to the policy owner's correct and most recent address

- Annually notify policyowners of their right to designate a third party to receive lapse notices

- Allow any designated third party to receive copies of all lapse and termination notices

 Courts have held that these requirements apply to all California life insurance policies in force as of or after January 1, 2013. If the insurer failed to comply with any of these requirements, the policy may not have legally lapsed — and the death benefit may still be payable.

California Misrepresentation Standard

 California courts have held that an insurer may rescind a life insurance policy based on misrepresentation only if the misrepresentation was material — meaning it would have had a substantial effect on the insurer's underwriting decision. A misrepresentation that had no bearing on the insured's cause of death is not automatically sufficient for rescission.

Additionally, if the insurer conducted its own pre-issuance medical investigation and obtained records that contained the allegedly undisclosed information, California courts have found that the insurer may be prevented from later relying on that same information to deny the claim.

The contestability period in California is two years. After two years, the insurer cannot contest the policy except for fraud.

California Divorce and Life Insurance — No Automatic Revocation

California does NOT have an automatic revocation upon divorce statute for life insurance policies. Unlike many other states, a divorce in California does not automatically remove an ex-spouse as a life insurance beneficiary. The ex-spouse named on the policy remains entitled to the proceeds unless the policyholder affirmatively changed the designation.

However, California is a community property state. If life insurance premiums were paid using community funds during the marriage, the surviving spouse may have a claim to a portion of the death benefit — even if not named as the beneficiary. This creates complex disputes that frequently require legal intervention.

California Accidental Death Exclusions

California courts apply a strict standard when interpreting accidental death exclusions. Coverage exclusions are generally disfavored under California law and are construed narrowly against the insurer. An insurer applying an exclusion — such as the sickness exclusion, intoxication exclusion, or narcotic exclusion — bears the burden of proving that the exclusion clearly and unambiguously applies to the facts of the death. An insurer that denies an accidental death claim without clear supporting evidence may be acting in bad faith under California law, exposing it to additional damages beyond the policy benefits
